Hi. Akiko and I were on the lawn except when we went to get food. Then our friend was watching our stuff. We decided not to know the sex of the baby. Since we are moving out of San Diego, we are not setting up a room and no need to worry about color schemes. We are both pretty traditional and want to wait to know. New Evidence Supports Bagel Shop Hoax Theory



Key to bagel shop mystery lies under thick layer of cream cheese



The San Diego Union Tribune (the rag) reported today that Einstein Bagels is apparently using technology to produce images of customers in their stores. A couple of customers known as Bjorn and Mary Ellen were often seen at the popular bagel shop and recently seemed to disappear completely. Local authorities originally thought the couple were simply too busy or too damn tired to make the drive from their alleged Palomar estate. New evidence suggests they were not really there in the first place. It has now been revealed the customers were simply holographic images produced to make the store seem busier. A thorough investigation of the store revealed no trace of Bjorn and Mary Ellen. Although a perplexing mystery, regular bagel shop patrons prefer not to throw too much light on the subject.

Hi. I want you to do really good on your finals. Need to talk about your school and you possibly staying at the condo. Anyway, Akiko and I were only going to the bagel shop every morning because it was my idea to give her a nice beginning to the day because her job totally sucked. Now she is home and there is not any need for a diversion. You might be happy to know eating all different things in the morning now. Eating bagels maybe only a couple times a month now. Would be happy to meet you there anytime though. Even better, come up for dinner anytime and stay the night. These days we are doing lots of teriyaki chicken BBQ and many other foods. Yummy stuff. Hi. I actually took some time off the sites and was able to watch the video you sent. Funny stuff. Yup, kinda thought they were a bit biased.



Anyway, beginning today need to work on taxes, yuk. This past weekend we renewed the passport for Akiko. The embassy folks came from LA to SD as a public service. We need to go back again in a couple weeks.



I continue to add new content to the education site. The more I add, the more I find. Already showing up in search since I linked to it from the other sites.



Akiko is finally getting the recipe site to work and now doing the fine tuning.

Hi. I am reading your email now. Akiko and I continue to work like crazy setting up the sites. I already made almost 200 pages on the home education site and this is only a small section of the site outline. The site should be close to 3000 pages when finished. Akiko uploaded about 8000 files to the host server and now was able to get the program to work. We talked about going out and Akiko wants to work until next week but definitely the week after next is perfect. Now we only go out for shopping and our afternoon walk. Everything is else is work. Kinda sucks but we really want to enjoy the summer and finish all the boring site stuff now. Still waiting for news on your site stuff. Anyway, tell the kids to hang in there a bit more. Hi. I think you probably already figured out we are not able to come up this weekend. This was a long week for us with most of it spent on the computer from early morning until the evening. We only went out to go shopping this week.



We had set a goal to get all of our sites online this week. Now there is a total of eight sites we are working on. All of mine are typical htm sites and do not require any special scripts. The site Akiko is working on is the recipe site and she already installed about 8000 files and then ran into problems with the hosting company server possibly not supporting the files.



In any event she is frustrated and there is no way I can pull her away from the computer until this is resolved. We already sent in a support ticket to the hosting company and now waiting for their answer.



Either way we should be good for the bagel store next week, probably more towards the end of the week. We could really use some time out with friends. Send email when you can.

Hi. Akiko and I planned to put a few sites online but ran into some problems deciding on community scripts and hosting companies which would support them. Really disappointed because the plan was to put these online this week.



Now with Google Friend Connect, it changed our thinking about the new sites. Instead of being stuck with an entire script on the site, Google is making it possible to add modules to get your site to do what you want. The problem is the technology if new and there is not enough modules now.



Anyway, yeah we are busy but only because of our thinking. We both are feeling a push to get the sites at least online before Akiko delivers this summer. We barely go out now except for shopping and walking. We set this month to get everything online at least and then work on it a little at a time.



We need to begin thinking about the move to Japan too. Anyway, things should settle and then we can all get together.



Wondering if you made any progress on the site stuff.

Hi. Akiko and I went to the bagel shop anyway on Saturday in the event you guys were able to make it. Getting really crowded because of the coupons.



As much as we want to, we cannot meet on Monday. We installed new Google technology on the English site this weekend and need to spend the next few days working out the bugs. Kind of difficult to explain. This was a Google beta release last year which was finalized on the 12th of this month. Basically you install script and can turn your site into an online community. This will eventually connect most of the famous sites together. It is called Friend Connect.

This is something we wanted to do on the English site for years but the technology was not available.



Anyway, now with the script installed, we need to focus on getting this promoted immediately. Probably going to be up very late tonight and I told Akiko we can sleep in tomorrow.

Hi. I wanted to get back to you again about our situation. Akiko and I received email from her manager today and the company laid off three more employees. Another friend, who works for the company, comes over often for dinner and keeps us in touch with the happenings at the company. It seems like the company is pretty much getting ready to close. It might be very difficult to prove discrimination at this point with many employees being laid off. A travel company, in this economy, is going to be really hit as people view travel as a luxury item. In any event, we are going to keep records of everything as there is still a chance we could move forward with the case if other things come up or if we find out others in the company experienced discrimination. Hi. The fact I am American though allows me to understand your thinking. I really do understand very well about Japanese not being confrontational after living and working in Japan many times.



These are the main points now. Because of the developments with COBRA, now Akiko is losing only a few thousand dollars and can stay home during her pregnancy. We think it would be difficult to prove her situation is difficult as our home is paid off and we still receive income from the state and generous benefit subsidies from the company.



We talked about this for awhile this morning and aside from things seeming better from a money perspective, Akiko does feel there was discrimination.



This was a very emotional week for us and at one point we were thinking about going back to Japan. Then the situation with the benefits changed and we decided to continue on with the original plan and stay in this country. The conclusion is, to at least take the weekend to think about everything and make a more rational and unemotional decision next week.



We will think about this over the weekend and maybe into next week a bit and then send you email with our decision. Enjoy your weekend and talk to you next week. Until then.

Without the meeting and production of documents as set forth in my previous email, I'm unable to give you an opinion.

What is the statute of limitations on a case like this and will waiting make the case weaker?

One year statute of limitations is what I would use. With respect to the events, people's memories dissipate as time goes by, documents get altered, lost, or destroyed; so to some degree waiting makes the case weaker.

As for a release, I cannot give you an opinion unless I actually meet with Akiko and view the document.

Hi. I want to apologize but we need to cancel our appointment for tomorrow. Some new developments changed things a bit. We applied for benefits this week and were declined. We decided to go with COBRA to extend the benefits Akiko had when she was working even though the cost is incredibly expensive. We needed some forms and called the human resources department of her company and were told of news regarding COBRA.



Apparently President Obama signed the American Recovery and Reinvestment Act of 2009 which contains a provision in which the government will force companies to pay for most of the COBRA costs of employees who were recently laid off.



The main reason for us wanting to take action against the company was because we felt it was wrong for them to lay off Akiko and put her in the position of costly benefits even while pregnant. Now with the benefits being much more affordable, Akiko is reluctant to take action against the company as she feels the main problem has been resolved. She wants more time to think about things. This brings us to a few questions.



With these new developments, how good do you think our case is?



What is the statute of limitations on a case like this and will waiting make the case weaker?



She was offered $500 to sign a long release stating she would not ever take action against the company which was not signed.



Is there a time limit for this release?

Hi. The following information pretty much covers why Akiko thinks she has a strong pregnancy discrimination case.



Akiko was hired to work at Pleasant Holidays, a Mission Valley travel company, on February 20, 2008. She was hired as a product automation agent and retained that position until her last day of work for the company. During her 11 months of employment with this company there was always plenty of work available for her to complete. In fact, she was offered overtime on numerous occasions due to the workload in her department and the lack of staff available to complete this work.



Akiko worked above and beyond what others in the company and in her department worked. In fact, Akiko consistently was able to find errors in the existing software which the company utilized in the online segment of their business. Akiko was often praised as being an excellent employee by both company managers and fellow employees alike. She was told many times that her job was secure and she need not ever worry about losing her job or her position with the company.



Akiko was also inline for additional training in the accounting aspects of the company along with other departments. We were so confident about the stability of her employment, we initiated steps towards purchasing a new single family residence.



Akiko discovered she was pregnant in early December 2008. She waited approximately two weeks to be sure of the pregnancy before telling her manager the news. Her manager was informed of the pregnancy sometime during the middle of December 2008.



After the manager knew of the pregnancy, things at work began to change for Akiko. The managers she worked with on a regular basis began to be short with her and some even avoided making eye contact. Akiko would often send email to these same managers about errors she found in the software. The emails were ignored and no reply was sent. After a couple weeks of this, it began to affect Akiko emotionally. She would come home upset and depressed and went to sleep soon after eating dinner every night. It became increasing more difficult for her to get up the energy to go to work. Because of her Japanese upbringing she still felt very devoted and loyal to the company and continued to do an excellent job at work even though the attitude towards her had changed.



Then on January 29, 2009, with no previous notice whatsoever, she was told her job was terminated and was asked to leave the company immediately. We believe the company planned the termination to coincide with end of the month to avoid payment of any additional benefits. Akiko was put in the position of being without medical benefits immediately and had to cancel an appointment with her gynecologist for the following week which has been scheduled weeks before.



The stress from this situation greatly affected Akiko and she became nauseous and very unhappy. Even considering the situation, Akiko was unwilling to make a case against the company. It was only recently that she realized the injustice of what the company put her through which made her decide to take action against the company.

Hi. I wanted to give you a bit of an update. Akiko now has a messed up tooth. We are without insurance because Kaiser turned Akiko down because she is pregnant. Seems like discrimination. Seems like things were gonna really suck but then this.



The American Recovery and Reinvestment Act of 2009 contains a COBRA provision which means the previous company needs to pay most of the cost for the continuation of our benefits. Yippee.



On another note, was reading stuff about the economy. Seems like the shit will really hit the fan in the next few months. Geeez.



Finished up an incredibly time consuming project on the English site. Changed 250 pages in the Travel America and Travel Abroad sections.



Anyway, this is a long time for all of us not to meet. Sure will be nice to get together when you return. Hopefully we can make it up to your place for the weekend as you offered. Will depend on her tooth, otherwise looks good. Send email when you can.

Hi. I wanted to mention a couple things we thought of the other night. Akiko said out of the three offices nationwide, only the SD office has her department. She said that there were approximately 15 people in her department when her job was terminated and she was the only one to be fired. In addition, beginning this month they are making people in her department work on the weekends to pick up the slack due to an increased work load in the department. Go figure. Hi. The following information pretty much covers why Akiko thinks she has a strong pregnancy discrimination case.



Akiko was hired to work at Pleasant Holidays, a Mission Valley travel company, on February 20, 2008. She was hired as a product automation agent and retained that position until her last day of work for the company. During her 11 months of employment with this company there was always plenty of work available for her to complete. In fact, she was offered overtime on numerous occasions due to the workload in her department and the lack of staff available to complete this work.



Akiko worked above and beyond what others in the company and in her department worked. In fact, Akiko consistently was able to find errors in the existing software which the company utilized in the online segment of their business. Akiko was often praised as being an excellent employee by both company managers and fellow employees alike. She was told many times that her job was secure and she need not ever worry about losing her job or her position with the company.



Akiko was also inline for additional training in the accounting aspects of the company along with other departments. We were so confident about the stability of her employment, we initiated steps towards purchasing a new single family residence.



Akiko discovered she was pregnant in early December 2008. She waited approximately two weeks to be sure of the pregnancy before telling her manager the news. Her manager was informed of the pregnancy sometime during the middle of December 2008.



After the manager knew of the pregnancy, things at work began to change for Akiko. The managers she worked with on a regular basis began to be short with her and some even avoided making eye contact. Akiko would often send email to these same managers about errors she found in the software. The emails were ignored and no reply was sent. After a couple weeks of this, it began to affect Akiko emotionally. She would come home upset and depressed and went to sleep soon after eating dinner every night. It became increasing more difficult for her to get up the energy to go to work. Because of her Japanese upbringing she still felt very devoted and loyal to the company and continued to do an excellent job at work even though the attitude towards her had changed.



Then on January 29, 2009, with no previous notice whatsoever, she was told her job was terminated and was asked to leave the company immediately. We believe the company planned the termination to coincide with end of the month to avoid payment of any additional benefits. Akiko was put in the position of being without medical benefits immediately and had to cancel an appointment with her gynecologist for the following week which has been scheduled weeks before.



The stress from this situation greatly affected Akiko and she became nauseous and very unhappy. Even considering the situation, Akiko was unwilling to make a case against the company. It was only recently that she realized the injustice of what the company put her through which made her decide to take action against the company.



We are asking you to please review the merits of this case and represent her in this matter.

We might be at the bagel store tomorrow. Slept in today after feeling like crap for the last couple days. The workout in the mountains was the beginning. Spent the next day Wednesday cleaning and vacuuming on my hands and knees preparing the place for our friend who stayed with us that night. Hi. Akiko and I can make it Thursday morning at 7:30 no problem. We are thinking about coming up this weekend, but quite honestly, we don’t want to overstay our welcome. Akiko being Japanese, makes her really worry about these things. We really want to know this is not a problem for you guys. We are making a warm food plan if we do come up though.



Anyway, the recorder names are really good. Already many thoughts on why some would be better. The router is an excellent idea. You can use the computer anywhere in your house and you can build in some good security. These things are pretty cheap and well worth it. We can do an Internet party at your dining room table. Fun stuff.



If you get it this week, we can all work on setting it up. You might consider going to Best Buy in Santee and talking to Robert. If you go, tell him the guy from Buffalo with the Japanese wife sent you. Trying anytime to find a knowledgeable salesperson and this guy knows his stuff.



Now working on a long overdue project. Completely redoing the site pages to make them more user friendly. Now updating about 160 grammar pages. The cutting and pasting extravaganza. Pretty boring. Anyway, talk to you in a couple days. Until then.

Cannot believe many residents spent the last few days in a hotel. We were at our friends house up in Palomar from Friday until Sunday night and expected everything to be back to normal already. Hi. I kinda figured you would get more snow up there. We shoulda stayed longer. We cannot take a shower as the meter is still off. Suppose they are waiting for SDGE to turn everything on again. Condos suck.

I would like you to send a list of the instruments you plan to play, hopefully all of them. You could also send some very basic information about each instrument if you want. I can get this information if you are too busy. These videos will be posted to the English YouTube account and embedded on the English site.



The other set of videos will be of you discussing your views about many of the topics we talked about over bagels and wine during our various meetings. I am not going to include subtitles for these videos as this would obviously be too time consuming. These videos will be posted to the SD YouTube account and embedded on the SD site.

Hi. I want to be really straight about this. Now with Akiko being pregnant and home every day we really value our privacy. Recently we stayed in the mountains with our friends up in Palomar and many friends coming for dinner or staying as house guests. It is a really nice time for us.



We are already renting a room to a guy, who is also my friend, which would not be possible if it was anyone else. This guy is extremely quiet and literally stays in his room the entire time except for eating. It is almost like there is no roommate. Usually I am only going to rent to women. Anyway, assuming your BF is not college student age, it would be impossible for me to stay in the same house with someone older, who is not related to me, who is a guy, and who is set in his ways.



Was kind of wondering if you considered him staying with your sister, which seems like the obvious choice.

About this weekend. It looks like we will come up on Friday to avoid the lowering snow levels and the potential requirement to need snow chains on Saturday. Unbelievable in terms of popularity. The site is ranked 49 in Alexa for world sites. Incredible some of the stuff on the Internet. Anyway, we will soon be seen throughout Russia, China, and Japan. Akiko and I went shopping today and ran into a lady who often goes to the bagel store. She said you guys were looking for us. We really wanna see you. Because Akiko was laid off today. Yup, she is now among the ranks of the unemployed. This is actually pretty good timing for us though since I need her back on the computer to do techie stuff. Hi. I was kinda hoping we could meet and you could be in some of the English site videos. Was able to persuade Akiko to be in a few but really not her thing. She is becoming quite popular on YouTube though. Seems like you might be too busy to meet now.



Anyway, the English site is doing phenomenally well with the addition of the new Classroom section. We are finally getting some pretty good income from the site. Because of this, and other factors, Akiko is leaning more towards staying in this country. It changes all the time though and I am waiting for her to finally decide.



Another factor is recently I connected with some old friends and made many new friends. The last few months were awesome with Akiko and I spending tons of time with these old and new friends. In fact, we go out for breakfast with many of them almost every day. We also made many dinner parties and were invited out for dinner a lot too. Really nice these days.

Hi again. I am still waiting for your reply to the original email which is now being resent. This email is also being sent to Shari Simpson. Originally all we wanted was for the one piece of wood to be painted which the painters, for some reason, forgot to paint. The painters told us not to move anything out on the patio since they planned to come back immediately to finish the job. They worked on the patio over a week ago. Now after closer inspection, we are requesting the entire patio be redone.



I was a real estate appraiser and property inspector for many years and know the difference between good and substandard construction. I cannot believe Mr. Wolven even subbed out to these guys. They obviously need to learn the usage of a T square. See the attached pictures.



The walls are not square and there is an excessive gap between the concrete and the lower sill. Really trying to work with you guys but my emails are ignored and attending an HOA meeting is pretty close to useless as residents are basically cut off after a few minutes even if their complaints are not totally expressed.



If there is no reply to this email this time I plan to resolve this another way. I am already in contact with an HOA attorney. Hopefully this mess can be resolved. Waiting for you to reply. Thanks.

Dear Julie,



Hi. I am writing to you about problems with one of your property managers. Shari Simpson is our only contact for issues concerning the Brentwood Condominiums. She needs to be educated in the ways of customer service. For over 20 years there was no need to complain about anything but recent problems now give me no choice.



Many repairs were made to the project over the last few months. Issues came up which Shari was notified about via email. She rarely returns emails. Last week our patio was redone. The wood was painted but the painters forgot a two foot section on the top rail. I told the painters about it and Shari. In fact, I sent pictures to her showing the unpainted portion of the patio. When there was no reply from her another email was sent. She then replied to my email and said I was “rude” and that my email was unappreciated and unacceptable. Another resident said Shari once slammed down the telephone and actually hung up on them during a telephone conversation.



THIS WOMEN NEEDS TO LEARN ABOUT CUSTOMER SERVICE. No matter what kind of attitude Shari receives from an owner or resident, SHE HAS NO RIGHT TO HANG UP ON THEM OR CALL THEM RUDE AND NOT REPLY TO THEIR EMAILS. All she needs to do is set up an auto reply on her email account to let senders know their emails were received. The HOA fees from our project and other projects you work with pay her salary and keep YOUR company in business. I was self employed as a real estate appraiser for many years. The customer service afforded to my clients made my company very successful, allowing me to retire early. I expect nothing less from your company. I expect a full apology from Shari ASAP.



Our patio furniture and two bikes have been sitting in our living room for a week and a half now and still Shari has done nothing to get this work completed. She was sent two other emails and, as usual, no replies were sent. As a common courtesy, she can at least acknowledge receipt of the emails.



In any event, my wife Akiko and I plan to move everything back on the patio tomorrow, Friday, since we are entertaining guests this weekend. We are going to Home Depot to purchase paint and complete the project ourselves. I am going to recommend to our HOA that a new management company be retained for the Brentwood Condominiums. Hi again. I really should tell you my wife and I became very frustrated with the way things are being run at the Brentwood. Many of our neighbors are complaining about the same issues but probably most of them are not putting their words into action. We complain about things which will become much greater problems in the future and still nothing is done. This is the reason for the “attitude” in my email.



The pine trees are a good example. Instead of removing these trees, which will inevitably need to be done someday, they actually put in more of these trees on the slope facing Navajo Road. The trees produce a tremendous amount of dust, debris, pollen, and sap not to mention being a fire hazard.



At this point we are getting ready to move back to Japan. Good news for you no doubt. We plan to rent the condo until values pick up in a few years, at which time we will be very happy to sell and move on.



Really unfortunate the issues facing this project are not put to a popular vote. Instead a few individuals are allowed to decide matters which detract from the livability, desirability, and the value of our units.



Incidentally, not trying to be “rude” at all. If this was your condo and you were in the same situation, no doubt you would be unhappy. We already spent a week with all our patio stuff in the living room which was unnecessary had they simply finished the job the same day last week. Send email when you can.

The patio was installed with a very wide space between the concrete and the wood. We are on a slope and now need to worry if anything falls on the floor of the patio it would roll down the slope and into the street. In addition, the wood does not seem to be treated which means the dryrot will come back in a few years.



In addition, I am requesting information from the HOA. The president stated at a previous meeting the mansards could not be removed from the top of the buildings because the adjacent condominium projects could sue our HOA for view issues. I consulted an HOA attorney two weeks ago who told me this is completely untrue. I would appreciate proof of the validity of the statements the HOA president made. Send when you can.

Hi. I can finally take a few minutes to return all the New Years email. Yup, incredible with a new baby and many changes coming this year. I pretty much spend every day now getting ready to go to Japan. Nothing definite at this point and still a chance we could go to Japan for a month and then come back and stay in this country. Really depends on Akiko. Either place is good for me though.



My English site finally made it in the rankings, especially with the new Classroom section. Now adding a lesson every day which is extremely time consuming. We plan to use the site as the base for opening schools in Japan if we decide to stay there.

Hi. I can be at the coffee shop from around 7:15 until 8:15 tomorrow. Spent the weekend watching football and working on the site during the games. Now making the pages much more user friendly. Tend to get excited about adding content and sometimes neglect design and the overall user experience. Anyway, we began full on marketing finally this week. Akiko is posting the videos on a Japanese site and a Chinese site, both similar to YouTube. The Japanese site uses technology which allows the visitors to post comments directly on the video. Hey, I was at the bagel shop with Akiko and saw Mary Ellen this morning. We cannot come up this weekend but would really like to see you guys tomorrow if you plan to be in SD. We will go to the bagel store if you guys can make it. No schedule tomorrow, therefore, we can talk until the cows come home, um or until they ask us to leave. Anyway, send email sometime today and let me know if you can make it. Bring a pillow since I plan to talk about the Internet and site stuff. Send email when you can.

Hi. Happy New Year. No worries about the email. Yup, Akiko and I spent a lot of time partying with friends this year. Kind of unusual for me because usually do not like the holidays. This year was different.



About your work. I know anytime you are going to be the top at whatever you do for sure. Even though you are not a native English speaker you can still find the motivation and determination to be the best at your career. I am going to support you anytime.



Kinda figured it would not be easy for you and Mimai to stay together. Relationships are difficult but long distance relationships are really really difficult. You cannot know what will happen though. You guys could meet again and get back together. It was the same with me and Akiko and now we are married with a baby coming.



Anyway, I really want you to try and come to SD before you go back to Japan. I think you might be going back before us. I tell you this often but you already know you are welcome anytime.
